This website, boombaba.in (the “Site”), is owned and operated by BOOMBABA VENTURES, a sole proprietorship concern of Mayank Prakash, having its principal place of business at Building No. 01, Pure Narsingh Bhan, Faizabad–Allahabad Road, near Pure Narsingh Bhan Branch Post Office, Dewkali Mod, Bela Pratapgarh, District Pratapgarh, Uttar Pradesh, 230001, and registered under GSTIN 09FOWPP0946H1Z5 (“BOOMBABA VENTURES”, “we”, “us”, “our”).

By accessing, browsing, registering on or purchasing from the Site, you (“you”, “your”, “the User”) agree to be bound by these Terms of Service (“Terms”), together with our Privacy Policy, Shipping Policy, Returns & Replacement Policy, Cookie Policy and Age Restriction & Responsible Use Policy, all of which are incorporated into these Terms by reference.

If you do not agree to these Terms, you must not use the Site.

You may use this Site and place an order only if all of the following are true:

• You are eighteen (18) years of age or older;
• You are competent to contract under Section 11 of the Indian Contract Act, 1872;
• You are not barred from receiving goods or services under any law in force in India;
• You are ordering for delivery to an address within India.

We do not sell to minors under any circumstances. By placing an order you confirm and warrant that you are 18 or older. We reserve the right to require proof of age at any point before or at the time of delivery, and to cancel any order where age cannot be satisfactorily established. Refer to our Age Restriction & Responsible Use Policy for the full position.

BOOMBABA VENTURES sells rolling papers, pre-rolled paper cones, filter tips, lighters and related accessories.

Please note carefully:

• Our products do not contain tobacco, nicotine, cannabis, or any narcotic, psychotropic or controlled substance of any kind.
• Our products are sold as accessories only. They contain no consumable substance and are supplied empty.
• We do not sell, supply, endorse or facilitate the acquisition of any substance that is unlawful to possess or consume in your jurisdiction.

You are solely responsible for how you use our products and for compliance with all laws applicable to you. Any use of our products in connection with an illegal substance is expressly prohibited, is entirely at your own risk, and is done without our knowledge, consent or endorsement.

You may browse the Site without an account, but you will need to provide information to complete a purchase. If you create an account:

• You must provide information that is accurate, current and complete, and keep it updated.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• You must notify us immediately at support@boombaba.in of any unauthorised use.

We may suspend or terminate an account, without notice, where we reasonably believe these Terms have been breached, where the account is used for fraud, or where we have reason to believe the holder is under 18.

We make reasonable efforts to display product colours, dimensions and descriptions accurately. Minor variation between the image on your screen and the product delivered is normal and is not a defect.

All prices are listed in Indian Rupees (₹) and are inclusive of applicable Goods and Services Tax unless stated otherwise. Shipping charges, where applicable, are shown separately at checkout before you pay.

We may change prices, revise product specifications, or withdraw a product from sale at any time without notice. Price changes do not apply retrospectively to orders already confirmed and paid for.

In the event of a manifest pricing or listing error — for example, a product displayed at a price plainly inconsistent with its normal price — we reserve the right to cancel the order even after confirmation, and to refund you in full. No order is a binding contract until we dispatch it.

• Your placement of an order is an offer to purchase, not a binding contract.
• Our confirmation email is an acknowledgement of receipt, not an acceptance.
• A binding contract is formed only when we dispatch the goods and send you a dispatch confirmation.

We may decline or cancel any order, in whole or in part, including where: stock is unavailable; the delivery PIN code is not serviceable; we suspect fraud, resale in breach of clause 8, or bulk buying by an unauthorised party; we cannot verify your age; or where a pricing error has occurred.

Where we cancel a paid order, we will refund you in full in accordance with our Returns & Replacement Policy.

We accept payment through our authorised payment partner Shiprocket Checkout, which may support UPI, debit cards, credit cards, net banking and wallets.

We do not store, process or have access to your complete card or banking credentials. All payment data is captured and processed directly by the gateway on PCI-DSS compliant infrastructure.

If a payment fails but an amount is debited from your account, the amount is typically reversed automatically by your bank or the gateway within 5 to 7 business days. If it is not, write to support@boombaba.in with the transaction reference and we will pursue it with the gateway on your behalf.

A valid GST tax invoice is issued for every order and sent to your registered email address.

• The Site and its products are for personal, non-commercial use by end consumers.
• You may not purchase through the Site for the purpose of commercial resale, redistribution or wholesale supply.
• Distributor, stockist and bulk enquiries are handled separately. Write to trade@boombaba.in — do not place a retail order for trade quantities.
• We may cancel, limit or refuse orders that appear to be for resale.

You must not:

• Use the Site for any unlawful purpose, or in breach of COTPA, 2003 or any other applicable law;
• Misrepresent your age or identity, or place an order on behalf of a person under 18;
• Copy, scrape, mirror, frame or reverse-engineer any part of the Site;
• Introduce any virus, trojan, worm or other malicious code, or attempt to gain unauthorised access to the Site, its servers or any connected database;
• Interfere with the proper working of the Site, including through denial-of-service activity or automated bulk requests;
• Post, upload or transmit content that is defamatory, obscene, harassing, infringing or otherwise unlawful, including in product reviews;
• Use our trade marks, brand name, logo or content without our prior written consent.

All content on the Site — including the BOOMBABA VENTURES name and logo, packaging design, product photography, illustrations, copy, page layout, and the compilation of all of it — is owned by or licensed to us and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.

You are granted a limited, revocable, non-exclusive, non-transferable licence to view and print pages from the Site for your own personal use. All other rights are reserved. No part of the Site may be reproduced, distributed, republished or commercially exploited without our prior written permission.

If you submit a review, photograph, comment or other material to the Site:

• You grant us a worldwide, royalty-free, perpetual, irrevocable, sub-licensable licence to use, reproduce, adapt, publish and display that material in connection with our business;
• You warrant that the material is your own, is accurate, does not infringe any third party’s rights, and does not depict a person under 18 or the consumption of any substance;
• We may edit, refuse to publish, or remove any submission at our sole discretion, without giving reasons.

The Site may contain links to third-party websites. Those links are provided for convenience only. We do not control, endorse or accept responsibility for the content, products, privacy practices or availability of any linked site. Visiting a linked site is at your own risk.

To the maximum extent permitted by law:

• The Site and its content are provided on an “as is” and “as available” basis, without warranty of any kind, express or implied.
• We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that defects will be corrected.
• Nothing in this clause excludes or limits any right or remedy you have as a “consumer” under the Consumer Protection Act, 2019, which cannot be excluded by contract.

To the maximum extent permitted by law:

• We will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, goodwill or data, arising out of or in connection with your use of the Site or our products.
• Our total aggregate liability in respect of any order will not exceed the total amount actually paid by you for that order.
• We accept no liability whatsoever for any consequence arising from the use of our products with any substance that is unlawful in your jurisdiction.

You agree to indemnify and hold harmless BOOMBABA VENTURES, its proprietor, employees and agents against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site or the products, your violation of any law, or your infringement of any third party’s rights.

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disaster, flood, fire, epidemic or pandemic, war, civil unrest, strike, transport disruption, failure of courier or payment infrastructure, power or internet outage, or any act, order or restriction of a government authority.

We may amend these Terms at any time. The amended version takes effect when posted on this page, and the “Last updated” date will change. Your continued use of the Site after that constitutes acceptance. Please review this page periodically. The Terms applicable to any order are those in force on the date the order was placed.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remainder will continue in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later.

These Terms are governed by and construed in accordance with the laws of India. Subject to the rights available to a consumer under the Consumer Protection Act, 2019, the courts at Pratapgarh, Uttar Pradesh shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

In compliance with the Information Technology Act, 2000 and the rules made thereunder, the details of our Grievance Officer are published on our Contact & Grievance Redressal page. Every complaint is acknowledged within 24 hours and resolved within 15 days of receipt.
